COPYRIGHT POLICIES FOR MATERIALS ON RESERVE
OR RESIDING ON KALAMAZOO COLLEGE SERVERS

Reserve and Materials on Kalamazoo College Servers
Materials placed on Reserve, both Print and Electronic, and materials residing
on Kalamazoo College servers must comply with copyright regulations
and conform to the U.S.
Government guidelines for Fair Use according to Title
17 of the United States Code. Please refer to the Information
Services Faculty Handbook Copyright Policy (pdf file) from the
Information Services Faculty
Handbook for guidelines on permissible copying of copyrighted
works. In addition, the Kalamazoo College Information Services General
User Agreement states that "materials that are owned by
others may not be published on Web pages (Personal or Official)
without the expressed permission of the owner."
Faculty must obtain copyright permission from the publisher or
copyright holder for items that do not conform to Fair Use guidelines.
Copyright permission must be granted for those items requiring
it before they can be processed for Print Reserve,
Electronic Reserve, or placed on Kalamazoo College servers. The
Circulation Department requires copies of letters of permission,
evidence of fees paid, or evidence of permission granted for submission
of Reserve items.
Permission to copy may be requested through the Copyright
Clearance Center (CCC).
The Library can help you obtain copyright permission from the CCC.

DETAILED RESERVE POLICIES AND COPYRIGHT: GUIDELINES
FOR PERMISSIBLE COPYING
These materials can be placed on Reserve without
copyright permission:

Books from the Kalamazoo College Library circulating collection
(Print Reserve only)
-
Personal instructor copies of books and audiovisual materials
-
Course materials created by the instructor, including exams,
solution files, lecture notes, and syllabi.

Audiovisual materials from the Library's collection
-
US Government Documents
-
Materials in the public domain
-
Excerpts copied from dramatic or musical works as long as the
excerpt is not a performable unit.

Copies made from items owned by Kalamazoo College Library:
-
An excerpt of a book, up to 10% of the publication
-
A journal article, limited to one article from a single journal
issue
-
A newspaper article
-
One short poem or short essay
Copies made from material not owned by the library:
The Library may place on Reserve photocopied excerpts from copyrighted
works in its collection in accordance with guidelines similar
to those governing formal classroom distribution for face-to-face
teaching (see the Information Services
Faculty Handbook Copyright Policy for details). Materials obtained
through Interlibrary Loan or MeLCat (books, photocopies, or electronic files) cannot be
placed on Reserve.
MATERIALS AND COPYING REQUIRING PERMISSION TO PLACE ON
RESERVE

Books, photocopies (book chapters, periodical articles, electronic files), and
other materials obtained through interlibrary loan, owned by
another library, or not owned by Kalamazoo College Library
-
Rented videos or any materials not owned by the library or
not the personal property of the instructor
-
Placing photocopied material on Reserve for multiple courses
-
Placing photocopied material on Reserve for successive quarters.
-
Standardized tests, exercises, workbooks, answer sheets, or
other commercial products of a similar nature, as well as duplications
of such works.

Creation of a collective work or anthology by photocopying
a number of copyrighted works.
-
Duplication of substantial portions of a work.
-
Duplication of performable units of dramatic or musical works.

Books from the Kalamazoo College Reference Collection

Unpublished manuscripts, including student papers, SIP's, and
theses that are not accompanied by written permission from the
author (see the Library's Policy on Unpublished
Works and Reserve for more information and a permission
form.)

Any materials that do not conform to copyright laws (Title
17 U.S. Code)
Note: Some items listed above can be placed on Reserve if the item
has received copyright clearance. Faculty must obtain copyright
permission from the copyright holder or publisher for items that
do not conform to Fair Use guidelines.
Permission to copy may be requested through the Copyright Clearance
Center (CCC). The Circulation Supervisor in the Library can help
you obtain copyright clearance from the CCC. Please contact Circulation
with questions and requests (circulation@kzoo.edu, 337-5731).

GUIDELINES FOR ELECTRONIC RESERVE AND MATERIALS PLACED
ON KALAMAZOO COLLEGE SERVERS:
Copyright laws require copyrighted materials on
Electronic Reserve and on course management systems to be password
protected to prevent unauthorized access to the material. The
Library's Electronic Reserve system protects documents this way
by placing them on a password protected server. Each item placed
on Electronic Reserve also includes a copyright notice indicating
that materials may be covered by copyright law.
These materials can be placed on Electronic
Reserve or Kalamazoo College servers without copyright permission:
1. Course materials created by the instructor, including course
exams, solution files, lecture notes, and syllabi.
2. US Government Documents
3. Materials in the public domain
These materials can be placed on Electronic
Reserve or Kalamazoo College servers without copyright permission
provided they are on a Kalamazoo College password-protected server. Text documents
must include a full citation and a copyright notice indicating
that materials may be covered by copyright law:
1. Photocopies of single book chapters from the Kalamazoo College
Library circulating collection (not to exceed 10% of the publication)
2. Photocopies of journal articles owned by Kalamazoo College
Library (limited to one article from a single journal issue)
3. Photocopies of newspaper articles owned by Kalamazoo College
Library
4. Copyrighted digital audio or video files, provided they meet
the requirements of fair use (Title 17, § 107 U.S. Code)
These materials cannot be placed on Electronic Reserve
or Kalamazoo College servers without copyright permission:
1. Any materials obtained through interlibrary loan or owned
by another library
2. Rented videos or any materials that are not either owned
by the library or the personal property of the instructor
3. Standardized tests, workbooks, answer sheets, or other commercial
products of a similar nature
4. Unpublished manuscripts, student papers, SIP's, or theses
